1. Service Description

PestLogPro provides cloud-based recordkeeping software designed to assist licensed pesticide applicators with maintaining application records. The Service includes application log management, compliance calendar, chemical inventory tracking, and document generation tools.

2. Compliance Disclaimer

IMPORTANT: PestLogPro provides recordkeeping tools to assist users with pesticide application record maintenance. PestLogPro does not guarantee that use of the Service ensures compliance with the Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA), any state pesticide law or regulation, or any other applicable federal, state, or local law.

Pesticide application recordkeeping requirements vary by state and are subject to change. Users are solely responsible for: (a) ensuring their records meet all applicable regulatory requirements; (b) verifying current requirements with their state pesticide regulatory authority; and (c) maintaining records in any additional format required by applicable law.

PestLogPro shall not be liable for any fines, penalties, license suspensions, loss of certification, loss of business, or other regulatory or civil consequences arising from a user's pesticide application activities, records, or compliance status.

3. Data Ownership

You retain full ownership of all data you enter into PestLogPro ("User Data"). PestLogPro claims no ownership rights in User Data. PestLogPro will not sell, license, or otherwise transfer User Data to any third party, except as necessary to provide the Service or as required by law. You may export your User Data at any time, including after cancellation of your account, during the 90-day data retention period.

4. Data Retention After Cancellation

  • Your account will enter read-only status. You may view and export all your records but may not create or edit records.
  • PestLogPro will retain your User Data for 90 days following cancellation. During this period, you may export all User Data in CSV or PDF format at no charge.
  • After the 90-day retention period, all User Data will be permanently and irreversibly deleted from PestLogPro systems.
  • PestLogPro recommends that users maintain independent copies of all pesticide application records as required by applicable law.

5. Free Trial and Billing

New accounts receive a 15-day free trial. During the trial period, your payment method will not be charged. Your card will be charged on the 16th day following account creation, which will be displayed during signup.

PestLogPro will send reminder emails at 7 days, 3 days, and 1 day before your first billing date. You may cancel at any time before your first billing date without charge.

You may cancel your subscription at any time through Settings > Billing. Cancellation takes effect at the end of your current billing period. No refunds are provided for partial billing periods, except where required by law. PestLogPro may change subscription prices upon 30 days written notice.

6. Limitation of Liability

To the maximum extent permitted by applicable law, PestLogPro's total liability for any claims arising from your use of the Service shall not exceed the amount you paid to PestLogPro in the 12 months preceding the claim. PestLogPro shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, loss of data, loss of licenses, regulatory fines, or business interruption.

7. Indemnification

You agree to indemnify and hold harmless PestLogPro and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from: (a) your use of the Service; (b) your pesticide application activities; (c) your violation of any applicable law or regulation; or (d) your violation of these Terms.
